Incorporation

In India, the process of incorporation of a company is governed by the Companies Act, 2013. Here are the broad steps involved in incorporating a company in India:

  1. Obtain Digital Signature Certificate (DSC): The first step in the incorporation process is to obtain a Digital Signature Certificate (DSC) for the proposed directors of the company. This is required for online filing of documents with the Ministry of Corporate Affairs (MCA).
  2. Reserve company name: You need to reserve a name for the proposed company with the MCA. The name should not be identical or similar to the name of an existing company.
  3. File incorporation documents: After the name is approved, you need to file the incorporation documents with the Registrar of Companies (ROC). The documents include the Memorandum of Association (MOA) and Articles of Association (AOA), along with other required forms.
  4. Obtain Certificate of Incorporation: Once the ROC is satisfied with the documents, it will issue a Certificate of Incorporation, which signifies the formation of the company.

These are only the basic steps involved in incorporating a company in India.
